Nebraska Medicine Text Message Service Terms and Conditions
Nebraska Medicine and its affiliates (collectively referred to as “Nebraska Medicine”, “Us”, “We”) offer text messaging service (“Service”) that allows you to receive information about your or your family member’s care via a mobile device. You agree to the following text messaging terms and conditions (“Terms”) pertaining to your usage of the Service. If you do not agree with the Terms, please immediately cease using the Service and opt-out pursuant to the opt-out procedures set forth below.
NEBRASKA MEDICINE MAY MODIFY THESE TERMS, OTHER TERMS AND MATERIALS REFERENCED IN THESE TERMS, OR THE SERVICE AT ANY TIME. FOR THIS REASON, YOU SHOULD REVIEW THESE TERMS PERIODICALLY. IF YOU DO NOT AGREE TO ANY SUCH MODIFICATIONS, DISCONTINUE USE OF THE SERVICE BY REPLYING “STOP” TO A NOTIFICATION FROM THE SERVICE.
Usage
The Service is delivered via recurring short message service (SMS) text messaging. You acknowledge that text messages are distributed via third-party mobile network providers and therefore Nebraska Medicine is not liable for, and cannot control, certain factors relating to message delivery. You acknowledge that, depending on your mobile provider service, it may not be possible for Nebraska Medicine to transmit the text messages to you successfully.
Nebraska Medicine does not claim or guarantee availability or performance of this Service, including liability for transmission delays or message failures.
Eligibility
You may elect the Service:
- If you have access to a One Chart | PATIENT account through Nebraska Medicine; or
- At the time of registration for point-of-care services at Nebraska Medicine.
You agree that you have a right to receive these text messages by electing the Service.
Service
The notifications that Nebraska Medicine may provide you through the Service include, but are not limited to, appointment reminders, notifications about your care or another person’s care, notification about payment obligations, one time passcode, prescription reminders, account updates, and One Chart | PATIENT messages. Text messaging is not available in all countries and not available via all carriers. Messaging frequency varies based on the notifications you have chosen to receive through the Service and the frequency of services you receive from Nebraska Medicine.
Opt-in: To opt-in to Nebraska Medicine's appointment notification text messaging, provide Nebraska Medicine your mobile phone number during your visit at Nebraska Medicine, or go to One Chart | PATIENT desktop website. Once you have opted-in, Nebraska Medicine will send you a confirmation welcome text message.
Opt-out: You may opt-out to future messages at any time by replying "STOP" from your mobile device, logging in to One Chart | PATIENT desktop website and managing your communication preferences, or by calling into Nebraska Medicine’s access team at (402) 552-3251.
Fees
Although the Service is complimentary, message and data rates may apply. Depending on your text plan, you may be charged by your carrier.
While we do not charge for this Service, we are not responsible for any charges from a person's service provider that may result from our providing this Service. It is the user's responsibility to check with their individual carrier, as standard messaging and data rates may apply. Nebraska Medicine assumes no responsibility for charges incurred by signing up for this Service. Any text messaging fees that you incur will be billed on your individual mobile provider bill.
Applicable Policies
The privacy of your personal information in the Site is governed by our Privacy Policy, our Notice of Privacy Practices, our One Chart | PATIENT terms, and by any consent form(s) and notice(s) that have been provided to you by your healthcare provider or by us.
Termination or Suspension
Nebraska Medicine reserves the right to suspend or terminate your access to the Service at any time without cause or prior notice.
Security
The Service is delivered through SMS. SMS is not encrypted and delivered via our third party vendor and your mobile carrier. Nebraska Medicine is not responsible for protecting or securing the Service.
Disclaimer
THIS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY LAW, NEBRASKA MEDICINE MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SERVICE OR CONTENT THAT YOU RECEIVE FROM NEBRASKA MEDICINE, AND DISCLAIM ANY WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE.
NEBRASKA MEDICINE DOES NOT GUARANTEE THAT YOU WILL BE ABLE TO RECEIVE SERVICE NOTIFICATIONS. NEBRASKA MEDICINE CANNOT GUARANTEE THAT THE SERVICE WILL BE ERROR FREE.
THE SERVICE AND THE CONTENT OF THE SERVICE ARE PROVIDED SOLELY FOR YOUR PERSONAL USE. RE-PUBLICATION, DISTRIBUTION, OR USE OF THE SERVICE THAT IS INCONSISTENT WITH THESE TERMS IS STRICTLY PROHIBITED.
Under no circumstances shall Nebraska Medicine be liable for incidental, special, indirect, direct or consequential damages, or related expenses which may arise from your use of or inability to use the Service, whether based on warranty, contract, tort, or any other legal theory, and whether or not Nebraska Medicine is advised of the possibility of such damages.
Applicable Law
These Terms are governed by and will be interpreted in accordance with the laws of the State of Nebraska.
Severability
Should any part of these Terms be determined invalid for any reason, you understand and agree that the remaining portions shall continue in effect.
